This privacy policy describes how Jen Gallaway, a licensed California Real Estate Agent (DRE# 02192884), affiliated with Keller Williams Realty, Wine Country office, collects and uses personal information through this website (jengallaway.com and any subdomains). It applies to visitors to this site only. Information you share with me through other channels (in person, by phone, by text, by email outside of this site, or through Keller Williams' transaction systems) is governed by Keller Williams' privacy practices and applicable real estate laws.
2. Information I collect
I collect personal information in two ways: information you give me directly, and information collected automatically when you visit the site.
Information you give me directly includes:
- Identifiers: name, email address, phone number, mailing address (when you submit a contact form, valuation request, or other inquiry)
- Property information: the address and characteristics of a home you're asking me to value or market (square footage, bedrooms, condition, etc.)
- Inquiry content: questions, comments, or details about your real estate goals that you choose to share
- Communication preferences: how you'd like me to reach you and when
Information collected automatically when you visit:
- Device and browser information: IP address, browser type, operating system, device type
- Usage information: pages you view, links you click, time spent on the site, referring website
- Cookies and similar technologies: small files my hosting provider may set to help the site function and to understand traffic patterns
I do not knowingly collect Sensitive Personal Information as defined under California law. I do not collect Social Security numbers, financial account credentials, biometric data, precise geolocation, or information about racial or ethnic origin, religious beliefs, sexual orientation, or union membership through this website.
3. How I use the information
I use information you share for these purposes:
- To respond to your inquiry, prepare a home valuation, or otherwise help with the real estate question you raised
- To send you information you specifically requested (a market analysis, listings matching your criteria, follow-up details)
- To follow up by phone, email, or text in connection with your real estate inquiry, with your consent
- To improve how the site works and what content I share
- To comply with my legal, regulatory, and professional obligations as a licensed Realtor® in California
I do not use your personal information to make automated decisions that produce legal or similarly significant effects about you.
4. Who I share the information with
I share information only as needed to help you, run my business, or comply with the law. Specifically:
- Service providers who help me operate the website and respond to inquiries: my hosting provider, my email provider, the form-processing service that delivers messages to my inbox, and similar vendors. These providers are contractually limited in how they may use your information.
- Keller Williams Realty when relevant to a transaction or required by brokerage rules. Each Keller Williams office is independently owned and operated.
- Third parties you specifically ask me to introduce you to, such as a lender, home inspector, contractor, or attorney. I will not pass your information to these parties without your knowledge.
- Government, regulatory, and legal authorities when required by law, subpoena, or court order, or to protect my legal rights or the safety of others.
I do not sell your personal information. I do not share your personal information for cross-context behavioral advertising. If that ever changes, I will update this policy and provide a "Do Not Sell or Share My Personal Information" link as required by California law.
5. Your California privacy rights (CCPA / CPRA)
If you are a California resident, you have the following rights regarding your personal information:
- Right to know: You can request that I tell you what categories of personal information I have collected about you, where I got it, why I collected it, and who I shared it with.
- Right to access: You can request a copy of the specific pieces of personal information I have collected about you.
- Right to delete: You can request that I delete personal information I have collected from you, subject to certain exceptions (for example, information I'm required to keep by real estate or tax law).
- Right to correct: You can request that I correct inaccurate personal information I have about you.
- Right to opt out of sale or sharing: I do not sell or share your personal information for cross-context behavioral advertising, but if I ever do, you have the right to opt out.
- Right to limit use of sensitive personal information: Although I do not knowingly collect sensitive personal information, you have the right to limit my use of any such information if I do.
- Right to non-discrimination: I will not discriminate against you (deny services, charge different prices, provide a different level of service) for exercising any of these rights.
How to exercise your rights: Email me at jengallaway@kw.com with the subject line "California Privacy Rights Request," or call me at 707.849.9689. Please tell me which right you'd like to exercise and provide enough information for me to verify your identity (typically your name, email, and a description of your prior interactions with me, so I can match it to my records). I will respond within 45 days of receiving a verifiable request, or let you know if I need an additional 45 days.
You may also designate an authorized agent to make a request on your behalf. The agent will need to provide a signed, written authorization from you.
6. Cookies and tracking technologies
This website uses minimal cookies. The site does not currently use Google Analytics, Meta Pixel, or other third-party tracking. If I add analytics or advertising tools in the future, I will update this policy and post a cookie banner where required by law. You can configure your browser to block cookies, but parts of the site may not work as intended.
7. How I keep your information secure
I use reasonable technical and organizational measures to protect personal information, including HTTPS encryption on this website and password protection on the email and form-handling services I rely on. No system is perfectly secure. If you believe your information has been compromised, please contact me immediately so I can investigate.
8. How long I keep your information
I keep personal information only as long as needed for the purpose I collected it, or as required by California real estate, tax, or other applicable law. Real estate transaction records are typically retained for at least three years under California Department of Real Estate rules, and longer if required by other regulations or my brokerage. After that, I delete or de-identify the information.
9. Children's privacy
This site is not directed to children under 16. I do not knowingly collect personal information from children under 16. If you believe a child has submitted information through this site, please contact me and I will delete it.
10. Out-of-state and international visitors
This site is operated from California, United States. If you visit from another state or country, your information will be transferred to and processed in the United States. By using this site, you consent to that transfer.
11. Fair housing notice
I am committed to complying with the Federal Fair Housing Act, California's Fair Employment and Housing Act, and all related federal, state, and local fair housing laws. I do not discriminate against any person on the basis of race, color, religion, sex, familial status, national origin, disability, gender identity, gender expression, sexual orientation, source of income, military or veteran status, ancestry, age, marital status, genetic information, or any other class protected under federal or California law.
